Terms and Conditions

§ 1 Scope & Provider

These Terms and Conditions (T&Cs) apply to all contracts for the acquisition of digital products (e-books) on www.syna29.com, operated by LePierre Publishing, an imprint of MEGA HOME Bauelemente & Solar GmbH, Ludwig-Erhard-Allee 10, D-76137 Karlsruhe, Germany, legal@syna29.com. Hardcover editions are exclusively available via Amazon. For the purchase, delivery, withdrawal, and warranty of hardcovers, Amazon’s Terms and Conditions and policies apply exclusively.

 

§ 2 Contract Conclusion

  • The contract for the acquisition of a simple, non-transferable, perpetual license for an e-book is concluded upon order completion on www.syna29.com and receipt of a confirmation email (§ 312j BGB).

  • The presentation of e-books on www.syna29.com is not a legally binding offer but an invitation to submit an order.

 

§ 3 Prices & Payment

  • Prices: Prices for e-books are displayed in Euro (€) and include statutory VAT (currently 7% for digital products in Germany, § 12 para. 2 no. 11 UStG). For customers outside the EU, prices are displayed without VAT, and any applicable local sales tax (e.g., VAT, GST) is borne by the customer per local law. Prices comply with the Preisangabenverordnung (PAnGV) and are final (no hidden fees).

  • Payment Methods: PayPal, credit card (Visa, Mastercard), further methods as available. Payment is due before download.

  • Invoice: Invoices are provided electronically via email.

 

§ 4 Delivery & Update Obligation

  • Delivery: E-books are provided immediately after successful payment confirmation as a personal, perpetual download link sent to the email address provided during the order. The link is valid for 7 days and can be used up to 3 times. For technical issues (e.g., defective link), contact hello@syna29.com – we will provide a new link free of charge. The provision of the download fulfills our delivery obligation (§ 362 BGB).

  • Update Obligation: No updates are required for e-books beyond the initial provision to maintain contractual conformity (§ 327f BGB).

 

§ 5 Warranty

  • E-books are subject to statutory warranty rights for digital products (§ 327e BGB). No warranty is provided for content-related errors (e.g., typos, factual inaccuracies), as these are artistic works subject to freedom of expression and art (Art. 5 GG). Technical defects (e.g., corrupted files, unreadable formats) are rectified free of charge (replacement download within 24 hours). For content-related complaints, we offer a one-time discretionary resolution (e.g., 20% discount voucher for the next purchase) – this is voluntary and does not establish a legal claim.

  • For hardcovers, Amazon’s warranty regulations apply exclusively.

 

§ 6 Governing Law & Jurisdiction

All interactions with this website, SYN//Λ29, and related content are governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law is made in accordance with applicable EU regulations and does not deprive consumers of mandatory protections under their local laws.

 

§ 6.1 B2B Disputes

All disputes arising from business-to-business (B2B) interactions are subject to binding arbitration under the Rules of the International Chamber of Commerce (ICC) in Karlsruhe, Germany. Arbitration awards are final, binding, and enforceable in over 160 countries under the New York Convention (1958). The business partner confirms they had the opportunity to seek professional advice on the meaning of the referenced German legal provisions and accepts their applicability. By engaging with LePierre Publishing in a B2B capacity, you irrevocably waive the right to litigate in any other forum. This clause complies with §1031 ZPO.

 

§ 6.2 B2C Disputes

For business-to-consumer (B2C) disputes, consumers retain all rights under mandatory consumer protection laws, including the Brussels Ia Regulation (EU) No 1215/2012 and EU Regulation 524/2013 (ODR Platform). Claims may be brought in the consumer’s local jurisdiction. We participate in the EU Online Dispute Resolution platform (https://ec.europa.eu/odr). All statutory consumer rights, including the right of withdrawal, are fully preserved.

 

§ 6.3 Dynamic Legal Adaptation

References to legal provisions apply to their current version, including future amendments. Users will be notified of material changes via email (if provided) or prominent website notices, ensuring compliance with §308 No. 5 BGB to avoid any unreasonable disadvantage.

 

§ 6.4 Governing Language

These T&Cs are provided in German and English. The German version is exclusively legally binding. The English translation is provided solely for better understanding for international users and has no legal effect. In case of contradictions or ambiguities, the German wording prevails. Users who are not proficient in German are advised to seek legal advice before concluding the contract.

 

§ 7 Acceptance of Terms (Clickwrap Agreement with Immutable Logging & AI Monitoring)

These Terms become binding only upon your active acceptance by checking the designated box during purchase, account registration, or download. The checkbox reads:
“I accept the Terms and Conditions, including the cancellation policy, data protection notice, and jurisdiction clauses. I understand that this agreement is legally binding and that my consent is being logged immutably.”
Non-acceptance prevents transaction completion, ensuring informed consent under §312i BGB.

 

§ 7.1 Immutable Consent Logging & AI Monitoring

  • Server-Side Logging: Every consent is logged minimally invasively with the following data:

    • Timestamp (UTC),

    • Pseudonymized IP address (deleted after 30 days unless required for disputes),

    • User-Agent (browser/device type),

    • Exact wording of the accepted clause,

    • SHA-256 cryptographic hash (for integrity verification).
      Data is stored solely for contract execution and dispute resolution (GDPR Art. 5(1)(b)) and deleted after 10 years (or earlier if no longer needed). Users can request their log data at any time via hello@syna29.com (GDPR Art. 15).

  • AI Analysis: Customer service communications and transactions are scanned for compliance using AI tools with mandatory human oversight. No employee may override the system without documented managerial approval. AI systems are low-risk under the EU AI Act.
    To deter frivolous claims, logs are admissible in disputes, and we reserve the right to seek cost reimbursement for baseless actions under §823 BGB or §91 ZPO.

 

§ 8 Right of Withdrawal – 100% BGB-Compliant with AI Enforcement and Cancellation Button

Per BGH ruling I ZR 161/24 (May 22, 2025), we provide a prominent “Cancellation Button” on www.syna29.com for easy revocation of e-book licenses (§312k BGB). The button, labeled “Exercise Cancellation,” leads to a barrier-free confirmation page.

 

§ 8.1 For Digital Products (E-Books)

  • Right of Withdrawal: You have 14 days from contract conclusion to withdraw the license for an e-book without reason (§355 BGB).

  • Expiration of Right: The right expires only after you explicitly consent to immediate performance and acknowledge loss of the withdrawal right upon download (§356 para. 5 BGB). You are informed of this prior to contract conclusion via a separate notice.

  • Consent Process: Before download, you must confirm via checkbox: “I consent to immediate contract performance and acknowledge that I lose my right of withdrawal upon downloading the digital content.” This is logged immutably.

  • Refund Policy: If withdrawn before download, a full refund is issued within 72 hours via the original payment method. After download, the right of withdrawal expires (§356 para. 5 BGB). In exceptional hardship cases (e.g., technical issues, error), we offer a one-time discretionary refund (50% of the purchase price) or a 100% voucher. This is voluntary and does not establish a legal claim. Decisions are made at our discretion (§315 BGB) within 7 business days of request confirmation.

 

§ 8.2 For Physical Products (Hardcover Books)

Hardcover editions are exclusively available via Amazon. For withdrawal, returns, and warranty, Amazon’s Terms and Conditions and policies apply exclusively.

§ 9 Customer Service Policy – No Exceptions Without Approval

  • Standard Responses: Responses are pre-approved, logged, and compliant with consumer laws. Employees cannot promise refunds or exceptions without managerial review.

  • Escalation Protocol: Exception requests are legally reviewed and logged, ensuring fairness under §242 BGB.

  • Public Transparency: Guidelines, response times, and no-exceptions policy are published on www.syna29.com. Annual reports detail compliance rates.

 

§ 10 Intellectual Property & Prohibited Use – AI-Monitored Enforcement

  • Copyright: Content protected under Berne Convention, DMCA, and German UrhG. Unauthorized use (e.g., AI training, scraping) prohibited.

  • Prohibited Actions: B2B violations may incur penalties up to €50,000, proportionate to harm. B2C limited to actual damages or €1,000 max (§307 BGB). Penalties require prior warning and cure opportunity.

  • AI Enforcement: Automated detection; enforcement after legal review.

  • Public Relations Policy: Education over penalties for individuals. Annual transparency reports and free consultations for inadvertent infringements.

 

§ 11 Platform-Specific Terms (Amazon, Kobo, Apple Books, Google Books)

E-books are offered via www.syna29.com, Amazon KDP, Kobo Writing Life, Apple Books, and Google Books, granting a simple, non-transferable license. Hardcovers are exclusive to Amazon. Purchases via third-party platforms are governed exclusively by their terms and policies. LePierre Publishing has no influence over:

  • Price changes,

  • Withdrawal conditions,

  • Warranty claims, or

  • Account suspensions by the platform.
    We assume no liability for actions or decisions by the platforms. For disputes with a platform (e.g., Amazon), please contact their customer service directly. Our T&Cs apply only to direct purchases on www.syna29.com.

 

§ 12 Youth Protection & Age Verification

  • Recommended Age: Products recommended for ages 16+ due to mature themes, not classified as harmful under JuSchG.

  • Verification: Acquisition of a license requires checkbox: “I confirm I am at least 16 years old or have parental consent.” Voluntary and logged.

 

§ 13 Change of Control & Succession Planning

In case of ownership change, merger, sale, or bankruptcy of MEGA HOME Bauelemente & Solar GmbH, users will be informed via email and website notices. Intellectual property rights (copyrights, trademarks) are vested in Pierre Hahn personally and/or LePierre Publishing as an independent imprint, unaffected by corporate changes (§103 InsO). ISBNs do not determine ownership; rights are secured via DPMA/EUIPO registrations and contracts with automatic reversion to Pierre Hahn. Transfers require his explicit consent, deterring challenges.

 

§ 14 Transparency in Public Relations – Artistic Integrity & Legal Transparency

  • Artistic Mission: LePierre Publishing supports creators; IP measures protect without targeting individuals.

  • Transparency Reports: We publish an annual report by January 31 covering:

    • Number of enforcement actions/abmahns (broken down by B2B/B2C),

    • Success rate of amicable resolutions (target: >90%),

    • Number of supported artists (e.g., via discretionary resolutions or grants),

    • Response times to GDPR requests (target: <48 hours).
      Reports are publicly available at www.syna29.com/transparency, ensuring legal certainty and trust.

  • Goodwill Policy: Free consultations for potential infringers.

  • Frivolous Claims Policy: Baseless abmahns (e.g., under UWG, GDPR, AI Act) will be contested, with cost reimbursement pursued (§91 ZPO) and public disclosure.
